The Court of Appeal has unanimously dismissed appeals by Jane Nicklinson and Paul Lamb challenging the legal ban on voluntary euthanasia.
By a majority decision the Court has allowed an appeal by AM (known as “Martin”) to the Policy for Prosecutors in Respect of Cases of Encouraging or Assisting Suicide. Lord Dyson, the Master of the Rolls, and Lord Justice Elias concluded in their majority judgment that the policy should provide greater foreseeability of prosecution in a case where assistance with suicide had been provided by a person, such as a health care professional, with no emotional ties with the person committing suicide. The Lord Chief Justice gave a dissenting judgment.
An application has been made by the CPS to the Court of Appeal for permission to appeal to the Supreme Court.
